Where can I get data on the average industry salary by type of economic activity in the Moscow region. Where to get data on the average industry salary by type of economic activity in the Moscow region How to find out the average salary by industry

According to the tax authorities, all companies should pay employees the highest possible salaries, which will ensure the growth of payments to the budget. But the fight against shadow payments, or rather the efforts of inspectors aimed at legalizing such payments, sometimes make conscientious taxpayers worry, for whom it is not easy to maintain even the previous level of salaries during a crisis. What arguments can the company bring in its defense?

SITUATION

On September 2, 2009, we received a letter from the IFTS with a notification that, by type of activity, our organization (LLC) is obliged to pay salaries to employees of at least 22,934 rubles.

In addition, the letter contained an invitation to a meeting of the commission for control over the activities of enterprises and organizations, concerning the remuneration of workers. But, unfortunately, the letter by mail was delivered a week later than the date of the invitation.

Our organization operates federal law dated 06/19/2000 No. 82-FZ "On the minimum wage", the legislation of the city of Moscow (tripartite agreement of 12/24/2008, resolutions of the Moscow government) and Art. 133.1 Labor Code RF.

Are there laws that stipulate that the salary of employees (literally - the level of the average monthly salary per employee) is determined by the type economic activity? Our OKVED - 60.21.11.

In 2008 we joined the Moscow Transport Union (MTS). Does this mean that the average wage in our organization should correspond to the average salary of organizations - participants of MTS? Did the Federal Tax Service of Russia mean this in the notification?

Minimum wage or OKVED

To date, there is no standard legal act, which would establish an obligation for the employer, when determining the size of the salary, to be guided by the average monthly salary per employee by type of economic activity.

Order of the Federal Tax Service of Russia dated May 30, 2007 No. MM-3-06 / [email protected] established publicly available criteria for self-assessment of risks for taxpayers. This document states that if the tax burden the taxpayer is below its average level for business entities in a particular industry (type of economic activity), it will be included in the plan of field trips tax audits. That is, this document does not oblige to be guided by the average monthly salary of an employee by type of economic activity, but only warns the taxpayer about his inclusion in the plan of on-site tax audits according to the named criterion.

One of the methods of combating shadow wages is to call the head of the organization to the so-called salary commission. In the capital, this commission operates on the basis of the order of the Federal Tax Service of Russia for Moscow dated February 22, 2008 No. 96.

We emphasize that the task of the tax authority is not to increase the wages of employees, but to remove unofficial wages from the shadow in order to fully transfer payroll taxes to the budget.

The relationship between the employee and the employer, in particular wages, is regulated by the Labor Code of the Russian Federation. The salary is set for the employee. employment contract in accordance with the employer's remuneration systems (Article 135 of the Labor Code of the Russian Federation), as well as taking into account the federal minimum wage and the minimum wage for the subject.

According to Art. 37 of the Constitution of the Russian Federation, everyone has the right to work in conditions that meet the requirements of safety and hygiene, to remuneration for work without any discrimination and not lower than the minimum wage established by federal law, the right to protection from unemployment.

Article 133 of the Labor Code of the Russian Federation establishes that the monthly salary of an employee who has fully worked out the norm of working hours for this period and fulfilled labor standards (labor duties) cannot be lower than the minimum wage. This value is established by the Federal Law of June 19, 2000 No. 82-FZ “On the Minimum Wage”. From January 1, 2009, the minimum wage is 4330 rubles.

Article 133.1 of the Labor Code of the Russian Federation provides that a regional agreement may establish the amount of the minimum wage in a constituent entity of the Russian Federation - in relation to those who work in the territory of the corresponding constituent entity of the Russian Federation, with the exception of employees of organizations financed from the federal budget.

The size of the minimum wage in the subject of the Federation is determined taking into account socio-economic conditions and the value of the subsistence minimum able-bodied population in the corresponding subject of the Russian Federation. It cannot be lower than the minimum wage established by federal law.

According to Art. 133.1 of the Labor Code of the Russian Federation, the monthly salary of an employee working in the territory of the corresponding constituent entity of the Russian Federation and who is in an employment relationship with an employer in respect of which the regional agreement on the minimum wage is valid in accordance with Parts 3 and 4 of Art. 48 of the Labor Code of the Russian Federation or to which the named agreement is extended in the manner prescribed by Part 6-8 of Art. 133.1 of the Labor Code of the Russian Federation, cannot be lower than the minimum wage in this subject of the Russian Federation. Mandatory condition: the specified employee has fully worked out the standard of working hours for this period and fulfilled the labor standards (labor duties).

On the territory of the capital, a minimum wage was established from January 1, 2009 - 8300 rubles, from May 1 - 8500 rubles, from September 1 - 8700 rubles. (Agreement on the minimum wage in the city of Moscow for 2009 between the Government of Moscow, Moscow associations of trade unions and Moscow associations of employers dated 24.12.2008). Wages in Moscow cannot be below this level.

In support of the above, we note that Art. 129 of the Labor Code of the Russian Federation reveals the concept of wages (wages). This is remuneration for work, depending on the qualifications of the employee, the complexity, quantity, quality and conditions of the work performed, as well as compensation payments(surcharges and allowances of a compensatory nature, including for work in conditions deviating from normal, work in special climatic conditions and in territories subjected to radioactive contamination, and other compensation payments) and incentive payments (additional payments and allowances of a stimulating nature, bonuses and other incentive payments).

Article 132 of the Labor Code of the Russian Federation establishes that the salary of each employee depends on his qualifications, the complexity of the work performed, the quantity and quality of labor expended and maximum size is not limited.

Conclusion: the approach to determining the wages of a particular employee depends on his professional qualities, such as qualifications, as well as on the complexity of the work, the quantity and quality of labor expended. Therefore, it is incorrect to generalize wages by industry (by type of economic activity), since there are no identical workers and all of them differ to a greater or lesser extent from each other in the level of professional knowledge.

What do taxpayers mean?

In the case under consideration, the Federal Tax Service of Russia had in mind not the level of wages of employees of organizations - participants of the Moscow Transport Union, but average salary by type of economic activity in the subject of the Federation, that is, in Moscow.

As follows from the order of the Federal Tax Service of Russia dated May 30, 2007 No. MM-3-06 / [email protected], information on statistical indicators of the average level of wages by type of economic activity in the city, district or in general for the subject of the Federation can be obtained from the following sources:

Information about the addresses of the websites of the departments of the Federal Tax Service of Russia for the constituent entities of the Russian Federation is available on the official website of the Federal Tax Service tax service www.nalog.ru

Average salary. Call for payroll. The formula for calculating the average industry salary

Question: From tax office I received a request to be called to the salary commission. They said that the salary of employees is less than the industry average. Where can I see the size of the average industry salary by type of economic activity in the Moscow region? What is the tax formula for calculating this average salary? Where is the data taken? We ourselves would like to calculate and verify their data.

Answer: there is no requirement in the Labor Code to set a salary above the industry average. But it is safer to stick to the industry average.

Averages calculates federal Service state statistics. These indicators are calculated based on the processing of static reporting provided by organizations and individual entrepreneurs and they are available on the website of Rosstat itself - http://www.gks.ru/ along with methodological explanations for the calculation.

Also keep in mind that the current legislation does not stipulate the obligation of the employer to maintain the salary of employees at a level not lower than the industry average. Accordingly, inspectors (both tax and labor) are not entitled to impose sanctions for the fact of paying wages below the industry average. However, the tax authorities can be held liable for the fact of paying gray wages. And the fact that your salary is lower than the industry average is, in their opinion, a reason to believe that you pay your salary “in an envelope”.

Rationale

Letter No. 15-08/075418 of the Federal Tax Service of Russia for Moscow dated August 8, 2007 “On monitoring organizations with low wages (extract)”

The tax authorities of Moscow are currently actively working to identify organizations operating on "shadow" schemes for paying wages. "Shadow" or "gray" wages are defined by the tax authorities as payments to employees that are not taxable - these are unofficial wages paid "in envelopes", insurance premiums and annuities paid through Insurance companies, and a number of other forms of hidden wages. Such schemes allow organizations to avoid paying the unified social tax, insurance premiums for mandatory pension insurance and income tax individuals. By evading the payment of these taxes and contributions, organizations not only deceive the state, but also worsen the social security of their employees. After all, the size of the future pension of working citizens depends on the size of the official salary, payment sick leave, including pregnancy and childbirth, the amount tax deductions when an employee purchases an apartment or the cost of educating his children.

Salary is the main component tax base on the unified social tax, personal income tax, as well as the base for calculating insurance premiums for mandatory pension insurance.

Therefore, under close attention tax authorities organizations with official salaries of employees below the industry average are included, where, as a rule, such salaries are additionally paid unaccounted for in the tax base, that is, funds hidden from taxation.

Origin of unrecorded cash Money everyone understands the organization, and such a situation will give the tax authorities reason to assume that organizations have tax violations not only on "salary" taxes. In most cases, the assumptions of the tax authorities are confirmed during audits.

Moscow's tax authorities monitor all organizations in the city that pay low wages. At the same time, issues of increasing the taxable base for "salary" taxes are resolved by hearing the heads of organizations at a special Commission, sending written appeals to organizations, transferring materials to prefectures and the city labor inspectorate. There are also field checks organizations that have signs of evading taxation by the unified social tax, personal income tax, insurance premiums for compulsory pension insurance.

Thus, the functions of the tax authorities are not to increase wages for employees of organizations (there are organizations that regulate labor relations for this), but to remove hidden forms of remuneration from the shadow. And if in an organization the actual wages are taken into account in full when taxed by the unified social tax and personal income tax, the tax authorities will not have claims against such an organization. At the same time, it does not matter what forms of labor relations the organization uses - full-time employment of full-time employees or part-time work.

Moscow is not just the capital of the Russian Federation, but also a metropolis with great opportunities and prospects. Not a single city in Russia can compare with the capital in terms of wages. The capital has the highest salaries in the entire country. Here, even for low-paid work, they receive 2-3 times more than in other regions. Russian Federation.

Salaries in Moscow are studied by the territorial body. This organization is briefly called "Mosgorstat". It is this institution that conducts research on what salaries are in demand and relevant in the labor market in Moscow, and also analyzes the level of salaries in various fields of activity and industries.

According to statistics, the average salary in Moscow in 2019 was 91,420 RUB.

Translated into foreign currency this amount is 1,483 USD.

All statistics are published inclusive of personal income tax. This means that 91,420 is the amount without paying taxes. On average, the rate of this tax is 13%, which means that, taking into account the payment of the tax payment, a person receives “clean” 79,535 RUB in his hands.

But even such an average salary in Moscow exceeds the average salary in Russia, which in 2019 was 42,332 RUB.

Minimum salary

MOT is minimum size wages. In Russia, there is a general minimum wage, as well as a regional and a minimum wage purely for Moscow.

The Moscow minimum wage depends directly on the subsistence minimum, which is set in this city once every 3 months. That is, if the subsistence minimum increases, then the minimum wage automatically increases. If living wage decreases, the minimum wage is maintained.

The minimum salary in Moscow from January 1, 2020 is 20195 RUB. According to the current legislation, each employer undertakes to pay his hired employee a salary not less than this amount. If the manager breaks the law and deliberately pays less than the minimum wage, then a fine of 50,000 RUB is imposed on him.

But it is worth remembering that if the employer has filed a reasoned refusal to apply the minimum wage to the Labor Inspectorate, then he has the right to pay his employees such a salary as he sees fit.

For comparison, it can be noted that the Moscow minimum wage is 5677 RUB more than the general minimum wage in the Russian Federation. This indicator indicates the development of the city and its stability in economic terms.

Is the salary below the industry average? letter from ifs. what to do?

Attention

Where to get industry average salaries and how to prepare for this challenge? Answer Before going to the commission, make an explanation. It is worth writing explanations on the letterhead of the company and signing with the head.

It is not difficult to explain the low salaries. There may be several reasons. For example, in a company, most employees work part-time or their income depends on the company's performance. If the performance indicators are negative, then the salary is below the average level.

All these arguments can be confirmed by a copy staffing and wage regulations.

The legislation leaves the right to the authorities of the constituent entities of the Russian Federation to establish their own "minimum wage", which will be no less than federal significance. If the region has a high standard of living, the minimum wage will be higher than the national average. For example, in Moscow it is 18,742 rubles for 2018.

What affects the average salary? When calculating the average salary, Rosstat takes into account the following elements:

  • salaries of employees;
  • bonus payments;
  • compensation and allowances;
  • social benefits from employers.

The modern methodology differs from the algorithm that existed earlier, when the “bare” salary was taken into account. To calculate the average salary, Rosstat uses information on the annual payroll received from domestic companies.

By the way, we recall that in June the All-Russian Public Opinion Center (VTsIOM) found out that at present, Russians are most concerned about low salaries. Due to frequent changes in legislation, information sometimes becomes outdated faster than we can update it on the site. All cases are very individual and depend on many factors.

But, unfortunately, the letter by mail was delivered a week later than the date of the invitation. Our organization operates with the Federal Law of June 19, 2000 No. 82-FZ “On the Minimum Wage”, the legislation of the city of Moscow (a tripartite agreement of December 24, 2008, resolutions of the Moscow government) and Art. 133.1 of the Labor Code of the Russian Federation. Are there laws that stipulate that the salary of employees (literally - the level of the average monthly salary per employee) is determined by the type of economic activity? Our OKVED - 60.21.11. Article 132 of the Labor Code of the Russian Federation establishes that the salary of each employee depends on his qualifications, the complexity of the work performed, the quantity and quality of labor expended and is not limited to a maximum amount.

The salary of employees consists of an official salary, which is approximately the same for everyone (10,000-15,000) rubles and a monthly bonus, the amount of which is determined by the director depending on the labor contribution of each employee to the volume of services rendered for a paid month (from 0 to 100,000) rubles. The purpose of the commission is to force the company to refuse envelope salaries.
